01. Acceptance of Terms
By accessing or using Bown Health (https://bown.health) and any associated services, applications, and coaching tools, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not access or use the application.
02. Description of Service
Bown Health is an athletic training platform that provides:
- Autonomic readiness evaluation by integrating sleep quality, HRV, resting heart rate, and training stress load.
- Dynamic workout prescription for competitive endurance cyclists and triathletes.
- Structured workout file compilation and synchronization for cycling head units (Garmin Edge).
- Telemetry debriefing, power interval analysis, and GPS activity route visualization.
03. Medical & Athletic Training Disclaimer: Cardiac & Physical Risk Assumption
Bown Health is an athletic training analytics and telemetry coaching application. It is NOT a medical device, diagnostic system, or clinical cardiac monitor, nor does it provide medical advice, diagnosis, or clinical treatment.
- Voluntary Assumption of Risk: High-intensity endurance cycling, interval training, threshold efforts, sprint intervals, and open-road cycling carry inherent physical risks, including but not limited to severe physical injury, cardiovascular distress, heart attack, heat exhaustion, collisions with motor vehicles or obstacles, and death. You voluntarily assume all such risks known or unknown.
- Physician Clearance Required: You represent and warrant that you are in good physical health and have consulted a licensed physician before embarking on any training regimen or maximal power testing suggested through the service.
- Listen to Your Body: Never disregard professional medical counsel, symptoms of illness, or delay seeking medical care because of scores or workouts suggested by Bown Health. If you experience chest tightness, dizziness, sudden shortness of breath, numbness, or palpitations, you must immediately halt exercise and contact emergency medical services.
04. AI Coaching Intelligence & Algorithmic Prescriptions
Bown Health leverages automated algorithmic models, physiological heuristics, and generative artificial intelligence (including Google Gemini and LLMs) to generate daily readiness assessments, mesocycle recommendations, workout interval targets, and hydration/nutrition prompts.
- All AI outputs are computational suggestions provided solely for experimental and recreational athletic self-optimization.
- AI recommendations do NOT constitute certified personal coaching, certified cycling instruction, or nutritional therapy.
- The athlete remains solely and exclusively responsible for verifying the safety of road routes, weather conditions, equipment suitability, and personal physiological readiness before performing any workout.
05. Initial Go-Live Test & Pilot Program Access
Users registering during the Initial Go-Live Pilot Test acknowledge that the service is in active pre-general release. Access is provided on an "AS IS" and "AS AVAILABLE" basis. Bown Health reserves the right to modify features, adjust promotional Bown balances, filter participant cohorts, or discontinue test modules at any time without liability.
06. Third-Party Integrations
Bown Health currently supports direct integrations with Garmin Connect (Garmin Edge cycling units, watches) and Google Health / Fitbit (Fitbit Aria 2, Fitbit smartwatches, Health Connect), as well as Intervals.icu and Strava. You acknowledge that:
- Integration requires your explicit authorization via OAuth 2.0 or secure credential provisioning.
- Bown Health is not responsible for third-party platform downtime, latency, or API deprecation.
- You may disconnect third-party services at any time in app Settings or through the respective platform provider.
07. Intellectual Property
All software code, visual designs, algorithms, workout compilation engines, audio synthesis integrations, and documentation comprising Bown Health are the exclusive property of Duncan Luke and Bown Health. You are granted a limited, personal, non-exclusive, revocable, non-transferable license to access the application for personal athletic training.
08. Limitation of Liability & Release
To the maximum extent permitted by applicable law, in no event shall Duncan Luke, Bown Health, or its operators, contributors, or contractors be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the application, training recommendations, AI coaching outputs, physical injury, cardiovascular incident, road accident, equipment failure, or loss of data. You expressly release and hold harmless Bown Health from any and all claims and causes of action.
09. Indemnification
You agree to defend, indemnify, and hold harmless Duncan Luke, Bown Health, and its affiliates from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising from or relating to your use of the service, participation in training activities, breach of these Terms, or violation of any rights of a third party.
10. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of Cape Town, South Africa.
